Otherwise every dead spellcaster would animate everything around them(grave dirt would become a earth elemental, a tree would become a treant, etc) and a Worm-That-Walks wouldn't be so rare.

Well, considering the fact that the worm that walks that he sees in The Festival evidently has the wizard's memories and personality, either he's commanding these worms or the worms are SO like him that they believe themselves to be him. Which honestly isn't really much different.
Anyways, in D&D it's emphatically the former. The wizard is the same guy, just embodied in a mass of worms.

Not that guy, but D&D canon. Kyuss, the BBEG of the Age of Worms campaign setting, was an epic cleric/wizard/necromancer who became the Worm That Walks by sacrificing a whole city of his fanatics. Dude's got the most powerful dracolich in the world as his second-in-command (who happens to have the highest TPK rate of any canon adventure path 'boss').

Good setting, by the way.

Thing is, in 3.0 you can make a Worm That Walks with a ritual, so the guy you're replying to is full of shit.
